It is crucial to explore crypto asset regulation and its effects on consumers from various perspectives as well as identify possible regulatory areas of concern for consumer protection in other fintech innovations.

To enhance understanding of crypto assets against the backdrop of the high profile collapse of the US based FTX crypto exchange and the subsequent arrest of its former CEO, Sam Bankman-Fried, the AGA-Africa Programme collaborated with the Department of Mercantile Law, University of Pretoria (UP) on a highly engaging Crypto Assets Regulations webinar held on 28th February, 2023.

The workshop brought together legal professionals as well as officers from Government Institutions and Agencies, Government Regulators and national, regional and international subject matter experts from South Africa, Mauritius and the United States.

The objective of the webinar was to provide a platform for the participants to identify and share knowledge on the current trends and best practices to strengthen cross-border and regional efforts relating to innovation, fintech and crypto assets to ensure sufficient consumer protection.

Kim Robinson, AGA-Africa Programme Country Coordinator for South Africa delivered the opening remarks on behalf of Markus Green, Board Member, AGA-Africa Programme followed by a keynote presentation by Jason Downs, Former Chief Deputy, Attorney General District of Columbia.

The webinar was moderated by Sylvia Papadopoulos, Associate Professor, Department of Mercantile Law, University of Pretoria and John Ukegbu, Senior Staff Attorney, Northeast New Jersey Legal Services and facilitated by Craig Pedersen, Head of TCG Forensics and Cybercrime Investigator, Eugene Du Toit, Head of Regulatory Framework, Financial Sector Conduct Authority, South Africa, Jessica Naga, Barrister and Chief Executive Officer, MINDEX GROUP, Jonathan Green ESQ, Partner Arnold & Porter and Former Assistant US Attorney and Senior Counsel Securities, Katherine Aizpuru, Staff Attorney, Division of Financial Practices, Federal Trade Commission’s Bureau of Consumer Protection and Professor Hilary Allen, Professor of Law and Associate Dean for Scholarship at the American University of Washington, College of Law.

 Workshop Outcomes

Through this workshop the participants:

  1. Were equipped with knowledge and skills on the current crypto asset regulations in South Africa and the importance of achieving a regulatory balance between the risks and benefits that innovation can bring.
  2. Enhanced their knowledge on Fintech and Crypto Assets from the US, Mauritius and South African perspectives.
  3. Gained an understanding of the importance of regional cooperation among practitioners, researchers and regulators in keeping abreast of innovations that enhance sufficient consumer protection.
